Cancellation policy
Consumers are entitled to a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity:
1. about the withdrawal policy
1.1 Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason
.The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last goods.
In order to exercise your right of withdrawal, you must inform us (SmileSecret GmbH & Co KG, Halle 6, Gutenbergstraße 5, 31180 Giesen /Emmerke, Tel. 0160/ 96690953, E-Mail: kundenservice@smilesecret.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period and that you have returned the goods within the period defined below.1.2 Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. We will retain a processing fee of €3.90 for processing. If acceptance is refused without a reason apparent to smile secret or if the goods cannot be delivered, the following fees will be charged:
- Shipments from DE/ AT fee in the amount of €9.90
- Shipments from all other countries €14.90
We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct costs of the insured return of the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the nature, properties and functioning of the goods.
1.3 Exclusion or premature expiry of the right of withdrawal
The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
General information
1. please avoid damaging and soiling the goods. Please return the goods to us in their original packaging and unopened with all contents.
2. please do not send the goods back to us freight collect if possible.
3. please note that compliance with the above conditions is a prerequisite for the effective exercise of the right of withdrawal.
